1. Agreement to Terms

The following are the terms of a legal agreement (“Terms” or “Agreement”) between you (“you” or “user”) and Psychedelic Foods LLC, a Florida limited liability company (“Psychedelic Foods,” “we,” “us,” or “our”). These Terms of Use (hereinafter “these Terms”) govern your use of this Site. By accessing, browsing, or using our website at psychedelicfoods.com (the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations.

If you do not agree to these Terms, you must discontinue use of the Site immediately.

Psychedelic Foods may, in its sole discretion and without prior notice, revise these Terms at any time by updating this posting. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes. We encourage you to review these Terms periodically.

2. About Psychedelic Foods

Psychedelic Foods LLC is a specialty freeze-dried food company based in Saint Johns, Florida. We sell premium freeze-dried herbs, spices, mushrooms, peppers, and herb blends through our online store at psychedelicfoods.com. Our brand name, “Psychedelic Foods,” is a creative and playful reference to the vivid, bold, and extraordinary flavors of our products. Psychedelic Foods does not manufacture, sell, distribute, or promote any controlled substances, psychoactive compounds, hallucinogenic materials, or any products intended to produce psychoactive effects. All of our products are conventional food items intended for culinary use.

The domain name psychedelicfoods.com serves as the consumer-facing web address for Psychedelic Foods LLC. References in these Terms to “the Site” encompass psychedelicfoods.com together with any sub-domains, social media presences, and other digital properties operated by Psychedelic Foods.

3. Intellectual Property and Content Ownership

3.1 Copyrights

All content and functionality on the Site—including but not limited to text, graphics, photographs, logos, icons, images, audio, video, software, and the selection, coordination, and arrangement thereof—is the exclusive property of Psychedelic Foods LLC or its respective licensors and is protected by United States and international copyright laws. All rights not expressly granted herein are reserved. You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this site.

Permission is granted to download or print a single copy of materials from the Site on a single computer or mobile device for your personal, non-commercial use only, provided that you (a) do not modify the materials, (b) retain all copyright, trademark, and other proprietary notices, and (c) do not use the materials in any way that suggests Psychedelic Foods’ endorsement of you or any third party. This limited permission terminates automatically if you breach any provision of these Terms.

You may not reproduce, distribute, republish, display, post, transmit, “mirror,” frame, scrape, data-mine, or create derivative works from any content on the Site without the prior written permission of Psychedelic Foods.

3.2 Trademarks

The trademarks, service marks, trade names, and logos (collectively, the “Trademarks”) displayed on the Site are registered and unregistered marks of Psychedelic Foods LLC. Protected marks include, but are not limited to:

The Psychedelic Foods name, logo, and associated designs;
The product line names: ShakerZ, PepperZ, ShroomZ, and Herb BlastZ; and
All associated taglines, slogans, and marketing phrases used on the Site.

Nothing on the Site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark without the prior written permission of Psychedelic Foods. Psychedelic Foods enforces its intellectual property rights to the fullest extent of the law. Use of any Trademark as part of a link to or from any website is prohibited unless approved in advance by Psychedelic Foods in writing.

Other trademarks, service marks, and trade names appearing on the Site may be the property of their respective owners and are used for identification purposes only.

4. Permitted and Prohibited Uses

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

Publish any Site material in any media;
Publicly performing and/or showing any Site material;
Use the Site in any way that violates any applicable local, state, national, or international law or regulation, including intellectual property laws;
Selling, sublicensing, and/or otherwise using the Site for any unauthorized commercial purpose, including advertising, solicitation, or spam;
Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;
Use any robot, spider, scraper, data mining tool, or other automated means to access, collect, or copy content from the Site;
Interfere with or disrupt the Site or the servers or networks connected to the Site, and/or using the Site in any way that impacts user access to the Site;
Introduce any viruses, trojan horses, worms, logic bombs, or other harmful or technologically destructive material;
Impersonate or attempt to impersonate Psychedelic Foods, a Psychedelic Foods employee, another user, or any other person or entity;
Use the Site in any way that causes or may cause harm or disadvantage to Psychedelic Foods or third parties;
Infringing or potentially infringing on the rights, reputation, or credibility of the Company or third parties;
Using the Site to engage in any advertising or marketing;
Engaging in activities that violate public order or morals;
Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Site;
Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site; or
Any other activity deemed inappropriate by Psychedelic Foods.

5. E-Commerce, Products, and Purchases

Psychedelic Foods offers specialty freeze-dried food products for sale through our Site, which is powered by the Shopify e-commerce platform. The following terms apply to any purchases made through the Site:

5.1 Product Information and Pricing

We strive to display product descriptions, images, and pricing as accurately as possible. However, we do not warrant that product descriptions, photographs, pricing, or other content on the Site is accurate, complete, current, or error-free. Colors and appearances may vary due to your monitor settings, lighting conditions, or other factors. If a product offered on the Site is not as described, your sole remedy is to return it in accordance with our applicable return and refund policy.

We reserve the right to correct any errors in pricing or product descriptions and to cancel any orders placed at an incorrect price, even after your order has been confirmed. All prices are in U.S. dollars unless otherwise indicated.

5.2 Order Acceptance

Your placement of an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud, or other issues identified by our payment processing providers. We may also limit or cancel quantities purchased per person, per household, or per order.

5.3 Payment and Sales Tax

Payment is processed through our third-party payment processor at the time of purchase. Applicable sales tax will be calculated and applied in accordance with the laws of the State of Florida and the requirements of any other jurisdiction where we are required to collect tax. Florida uses a destination-based approach for sales tax on e-commerce transactions; the tax rate applied to your order may vary depending on your shipping address.

5.4 Shipping

All orders are shipped via FedEx Ground within the continental United States. Shipping rates, estimated delivery times, and other shipping details are published on the Site at the time of checkout. Psychedelic Foods is not responsible for delays caused by FedEx, weather, natural disasters, or other circumstances beyond our control.

We currently do not ship internationally or to P.O. boxes.

5.5 Returns, Refunds, and Cancellations

In accordance with Florida Statute § 501.142, our refund and return policy is disclosed prior to purchase and is available on the Site. Due to the perishable nature of food products, all sales are final unless the product arrives damaged, defective, or materially different from the description on the Site. If you receive a damaged or defective product, please contact us within seven (7) days of delivery at the contact information provided in Section 20 below. We may, at our sole discretion, issue a replacement or a refund.

Order cancellations may be requested prior to shipment by contacting us promptly. Once an order has shipped, it is subject to our return policy as described above.

5.6 Food Safety and Allergen Disclaimer

All Psychedelic Foods products are food items intended for culinary use. While we take precautions to ensure the quality and safety of our products, you are responsible for reviewing all product ingredients, descriptions, and allergen information before making a purchase. Our products may be processed in facilities that also handle common allergens including but not limited to nuts, soy, wheat, dairy, and shellfish.

If you have known food allergies or sensitivities, please review product labels carefully and consult with a healthcare professional before consuming any of our products. Psychedelic Foods is not liable for any adverse reactions resulting from the consumption of our products where allergen information has been provided.

6. User Accounts

Certain features of the Site may require you to register and create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password associated with your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. Psychedelic Foods will not be liable for any loss or damage arising from your failure to protect your account credentials.

We reserve the right to disable, suspend, or terminate any user account at any time, in our sole discretion, for any or no reason, including if we believe that you have violated these Terms.

7. Privacy and Data Collection

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Psychedelic Foods and its members, managers, officers, employees, agents, representatives, successors, and assigns (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any rights of another person or entity, or (d) any content you submit or transmit through the Site.

16. Dispute Resolution and Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in St. Johns County, Florida, and you hereby consent to the personal jurisdiction of such courts.

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

17. Copyright Infringement Notices (DMCA)

Psychedelic Foods respects the intellectual property rights of others and prohibits the posting of any material that infringes or violates the copyright or other intellectual property rights of any person or entity. If you believe that material on our Site infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512(c)(3), to our designated agent.

18. Controlled Substance Disclaimer

IMPORTANT: The name “Psychedelic Foods” is a registered trade name used for branding and marketing purposes only. It is intended to evoke the bold, vivid, and extraordinary character of our freeze-dried food products. Psychedelic Foods LLC does not manufacture, sell, market, distribute, or promote any controlled substances, psychoactive compounds, hallucinogenic materials, psilocybin, or any other substances regulated under the Controlled Substances Act (21 U.S.C. § 811 et seq.) or any analogous state law.

All products sold by Psychedelic Foods are conventional food items—including freeze-dried herbs, spices, mushrooms (culinary varieties only), peppers, and herb blends—intended solely for culinary and household use. No product sold on this Site is intended to diagnose, treat, cure, or prevent any disease, and no product contains psychoactive or controlled ingredients.

19. Entire Agreement and Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Psychedelic Foods.
